REGISTRO DE HUÉSPED, ACUERDO DE RESPONSABILIDAD Y POLÍTICA DE ESTANCIA
Para efectos del presente acuerdo, “Planta”, “Planta Glamp” o “Planta Farm” se refiere a la propiedad operada bajo cualquiera de dichos nombres y legalmente propiedad de Gardens and Flowers 2004, S.A. de C.V., incluyendo a sus propietarios, directivos, empleados, contratistas, colaboradores y representantes.
Al firmar este documento o confirmar mi reservación, declaro y acepto lo siguiente:
CONDICIÓN FÍSICA, SALUD Y ASUNCIÓN DE RIESGOS NATURALES
El huésped declara que tanto él/ella como todos los integrantes de su grupo se encuentran en condiciones físicas y de salud adecuadas para participar en una experiencia en entorno rural, selvático y natural como la ofrecida por Planta.
Reconoce que la propiedad se ubica dentro de un ecosistema natural activo, abierto y no controlado, que puede incluir, entre otros elementos: insectos, mosquitos, hormigas, arácnidos, reptiles, anfibios, aves, fauna silvestre, animales domésticos, vegetación densa, espinas, polen, tierra, lodo, humedad, polvo, así como condiciones climáticas variables como lluvia intensa, calor, humedad elevada y vientos fuertes.
El huésped reconoce expresamente que dentro de la propiedad existen árboles de gran altura y vegetación madura en zonas comunes, áreas de tránsito, cerca de cabañas y de la casa principal. En un entorno natural pueden ocurrir desprendimientos de ramas, caída total o parcial de árboles, caída de hojas, frutos u otros elementos naturales, especialmente durante lluvias, vientos fuertes, tormentas u otros fenómenos naturales.
El huésped entiende y acepta que tales eventos forman parte de los riesgos inherentes a permanecer en un entorno natural y que Planta no puede controlar completamente la naturaleza ni garantizar la ausencia de eventos naturales, catastróficos o no catastróficos.
Asimismo, reconoce que existen caminos irregulares, superficies desniveladas, piedras, raíces, pendientes, escaleras, estructuras de madera y ecotecnologías como baños secos (composta) y duchas al aire libre.
El huésped manifiesta no padecer alergias graves conocidas, hipersensibilidad a picaduras de insectos, afecciones respiratorias severas u otras condiciones médicas incompatibles con este tipo de entorno. En caso contrario, asume plena responsabilidad por su manejo, tratamiento y prevención durante la estancia.
El huésped reconoce que su participación es voluntaria y asume expresamente todos los riesgos inherentes asociados a la convivencia en un entorno natural y rural, incluyendo lesiones personales, daños materiales o pérdidas que puedan derivarse de fenómenos naturales o condiciones ambientales, liberando a Planta, sus propietarios y colaboradores de responsabilidad por dichos eventos, salvo dolo o negligencia grave comprobada conforme a la ley.
NATURALEZA DEL ESPACIO
Planta es una granja orgánica en funcionamiento ubicada en una zona rural y selvática. No es un hotel tradicional ni un entorno urbano controlado. Es un espacio natural, abierto, rústico y en constante interacción con el entorno ambiental.
El huésped reconoce que la experiencia implica contacto directo con naturaleza viva y que no es posible eliminar completamente la presencia de insectos, fauna, polvo, tierra, sonidos naturales o variaciones climáticas.
CONSTRUCCIÓN RÚSTICA Y AUTOCONSTRUCCIÓN
Las estructuras fueron autoconstruidas con técnicas rústicas y materiales naturales. Las cabañas son de madera y cuentan con mosquiteros en lugar de ventanas de vidrio. No se ofrecen estándares urbanos de aislamiento, sellado hermético o lujo tradicional. El huésped acepta expresamente estas características como parte esencial de la experiencia.
INSTALACIONES SANITARIAS Y DUCHAS
Las duchas son al aire libre. Los baños son secos (composta), de distintos tipos según la cabaña asignada. El baño principal requiere subir escaleras. El huésped acepta estas condiciones y su uso bajo su propia responsabilidad.
ACCESO Y CONDICIONES DEL CAMINO
El huésped reconoce que Planta se encuentra en una zona rural y que el acceso incluye tramos de terracería y una vereda rústica. Las condiciones pueden variar según clima, lluvias u otros factores fuera del control de Planta.
El ingreso en vehículo es bajo responsabilidad exclusiva del huésped. Planta no garantiza que el camino sea adecuado para todo tipo de vehículos. El huésped asume los riesgos inherentes al tránsito en zonas rurales, incluyendo superficies irregulares, lodo, piedras, pendientes y desniveles.
VEHÍCULOS Y ESTACIONAMIENTO
El estacionamiento se ofrece únicamente como cortesía y bajo responsabilidad exclusiva del huésped.
Planta no será responsable por daños, pérdida, robo total o parcial, vandalismo o cualquier afectación a vehículos, motocicletas, bicicletas u otros medios de transporte.
Planta tampoco asume responsabilidad por objetos, equipaje o pertenencias dejadas dentro de los vehículos.
ACCESIBILIDAD
La propiedad no está adaptada para personas con movilidad reducida. No existen rampas ni baños accesibles.
GRANJA EN FUNCIONAMIENTO
Es una granja activa. Puede haber herramientas manuales y eléctricas, equipo agrícola, materiales de construcción y mantenimiento constante. Existen áreas restringidas. El huésped no podrá manipular herramientas ni ingresar a zonas restringidas.
COCINA COMPARTIDA Y ZONAS DE FUEGO
La cocina es compartida y autogestiva. Contiene cuchillos, estufa de gas, estufa de leña y horno de leña. El huésped es responsable de su uso adecuado.
Las zonas de fogata también son autogestivas. Cualquier incidente derivado del uso de fuego, gas o utensilios será responsabilidad exclusiva del huésped.
ESPACIO COMPARTIDO Y AUSENCIA DE SUPERVISIÓN PERMANENTE
Es un espacio compartido y no se garantiza presencia permanente de personal en el sitio.
Planta no se hace responsable por actos u omisiones de otros huéspedes o terceros.
CONDUCTA EN ÁREAS COMUNES
Las áreas comunes deben utilizarse con respeto.
No se permiten actos íntimos o conductas sexuales explícitas en áreas comunes. Cualquier conducta que afecte la convivencia podrá resultar en retiro inmediato sin reembolso.
SERVICIOS, SUMINISTROS E INTERRUPCIONES
Debido a la ubicación rural, los servicios pueden ser limitados o intermitentes, incluyendo energía eléctrica, agua, internet y señal celular.
Planta no garantiza disponibilidad continua de servicios. Las interrupciones por causas fuera de su control no constituyen incumplimiento ni generan derecho automático a reembolso.
En caso de emergencia, la comunicación puede verse limitada por falta de señal o energía eléctrica.
TRANSPORTE Y PRESENCIA EN LA PROPIEDAD
Planta no ofrece ni garantiza servicios de transporte bajo ninguna circunstancia, incluyendo emergencias.
No existe obligación de mantener personal permanente en la propiedad.
El huésped es responsable de organizar su propio transporte y de contactar servicios públicos o privados en caso de emergencia.
SALUD Y EMERGENCIAS MÉDICAS
La propiedad se encuentra en zona apartada. Los servicios médicos pueden tardar en llegar. El huésped es responsable de contar con seguro médico y coordinar su atención.
CONDUCTA Y SUSTANCIAS
Se prohíben sustancias ilegales. Conductas disruptivas podrán resultar en retiro inmediato sin reembolso.
CUIDADO DEL ESPACIO Y RESPONSABILIDAD MATERIAL
El huésped acepta responsabilidad total por daños causados por acción u omisión, incluyendo mobiliario, estructuras, mosquiteros, instalaciones, equipo, plantas o animales.
AUTORIZACIÓN DE CARGOS
Autorizo a Inmobiliaria A04, S.A. de C.V. a realizar cargos por daños o adeudos pendientes.
OBJETOS PERSONALES
Planta no es responsable por pérdida, robo o daño de pertenencias personales.
USO COMERCIAL Y GRABACIONES
Cualquier uso comercial requiere autorización previa por escrito.
CÁMARAS DE SEGURIDAD
Existen cámaras en zonas comunes. No se instalan cámaras dentro de cabañas ni baños.
POLÍTICA DE CANCELACIÓN
Todas las reservaciones son finales y no reembolsables.
FUERZA MAYOR
En casos que imposibiliten objetivamente la operación, podrá ofrecerse reprogramación sujeta a disponibilidad.
FIRMA OBLIGATORIA
Debe firmarse dentro de 72 horas posteriores a la confirmación.
AVISO DE PRIVACIDAD
Los datos se protegerán conforme a la ley mexicana aplicable.
NATURALEZA TEMPORAL DE LA OCUPACIÓN
La estancia es temporal y no genera derechos posesorios.
DERECHO DE ADMISIÓN
Planta se reserva el derecho de admisión y permanencia.
ASUNCIÓN DE RIESGO Y LIBERACIÓN
El huésped asume todos los riesgos y libera a Inmobiliaria A04, S.A. de C.V., salvo dolo o negligencia grave comprobada conforme a la ley.
JURISDICCIÓN
Este acuerdo se regirá por las leyes de los Estados Unidos Mexicanos. Las partes se someten a la jurisdicción de los tribunales competentes en el Estado de Oaxaca.
Al confirmar la reservación o ingresar a la propiedad, el huésped acepta íntegramente este acuerdo.

GUEST REGISTRATION, LIABILITY AGREEMENT AND STAY POLICY
For purposes of this agreement, “Planta,” “Planta Glamp,” or “Planta Farm” refers to the property operated under any of these names and legally owned by Gardens and Flowers 2004, S.A. de C.V., including its owners, directors, employees, contractors, collaborators, and representatives.
By signing this document or confirming my reservation, I declare and agree to the following:
PHYSICAL CONDITION, HEALTH, AND ASSUMPTION OF NATURAL RISKS
The Guest declares that he/she and all members of their group are in adequate physical and health condition to participate in a rural, jungle, and natural environment experience as offered by Planta.
The Guest acknowledges that the property is located within an active, open, and uncontrolled natural ecosystem, which may include, among other elements: insects, mosquitoes, ants, arachnids, reptiles, amphibians, birds, wildlife, domestic animals, dense vegetation, thorns, pollen, dirt, mud, humidity, dust, as well as variable weather conditions such as heavy rain, heat, high humidity, and strong winds.
The Guest expressly acknowledges that the property contains tall mature trees and vegetation in common areas, pathways, near cabins, and near the main house. In a natural environment, branches may fall, trees may partially or fully fall, and leaves, fruits, or other natural elements may drop, especially during rain, strong winds, storms, or other natural events.
The Guest understands and accepts that such events are inherent risks of staying in a natural environment and that Planta cannot fully control nature nor guarantee the absence of natural events, whether catastrophic or non-catastrophic.
The Guest further acknowledges the existence of uneven paths, irregular surfaces, rocks, roots, slopes, stairs, wooden structures, and eco-technologies such as compost toilets and outdoor showers.
The Guest declares that they do not suffer from severe known allergies, hypersensitivity to insect bites, severe respiratory conditions, or other medical conditions incompatible with this type of environment. Otherwise, they assume full responsibility for management and prevention during their stay.
The Guest acknowledges that participation is voluntary and expressly assumes all inherent risks associated with staying in a rural and natural environment, including personal injury, property damage, or losses arising from natural phenomena or environmental conditions, releasing Planta, its owners, and collaborators from liability for such events, except in cases of proven gross negligence or willful misconduct as provided by law.
NATURE OF THE SPACE
Planta is an operating organic farm located in a rural and jungle area. It is not a traditional hotel nor a controlled urban environment. It is a natural, open, rustic space in constant interaction with the surrounding ecosystem.
The Guest acknowledges that the experience involves direct contact with living nature and that it is not possible to completely eliminate the presence of insects, wildlife, dust, dirt, natural sounds, or weather variations.
RUSTIC CONSTRUCTION AND SELF-BUILT STRUCTURES
The structures were self-built using rustic techniques and natural materials. The cabins are made of wood and have mosquito screens instead of glass windows. Urban standards of insulation, airtight sealing, or traditional luxury are not offered. The Guest expressly accepts these characteristics as an essential part of the experience.
SANITARY FACILITIES AND SHOWERS
The showers are outdoor showers. The bathrooms are dry compost toilets of different types depending on the assigned cabin. The main bathroom requires climbing stairs. The Guest accepts these conditions and their use under their own responsibility.
ACCESS AND ROAD CONDITIONS
The Guest acknowledges that Planta is located in a rural area and that access includes dirt roads and a rustic path. Conditions may vary depending on weather, rainfall, or other factors beyond Planta’s control.
Entry by vehicle is under the sole responsibility of the Guest. Planta does not guarantee that the road is suitable for all types of vehicles. The Guest assumes the inherent risks of driving in rural areas, including uneven surfaces, mud, rocks, slopes, and irregular terrain.
VEHICLES AND PARKING
Parking is offered solely as a courtesy and under the exclusive responsibility of the Guest.
Planta shall not be responsible for damage, loss, total or partial theft, vandalism, or any other harm to cars, motorcycles, bicycles, or other means of transportation.
Planta also assumes no responsibility for objects, luggage, or personal belongings left inside vehicles.
ACCESSIBILITY
The property is not adapted for persons with reduced mobility. There are no ramps or accessible bathrooms.
OPERATING FARM
This is an active farm. There may be manual and electric tools, agricultural equipment, construction materials, and ongoing maintenance. Restricted areas exist. The Guest may not handle tools or enter restricted areas.
SHARED KITCHEN AND FIRE AREAS
The kitchen is shared and self-managed. It contains knives, a gas stove, a wood stove, and a wood-fired oven. The Guest is responsible for proper use.
Fire pit areas are also self-managed. Any incident arising from the use of fire, gas, or utensils shall be the sole responsibility of the Guest.
SHARED SPACE AND NO PERMANENT SUPERVISION
This is a shared space and permanent on-site staff presence is not guaranteed.
Planta is not responsible for acts or omissions of other guests or third parties.
CONDUCT IN COMMON AREAS
Common areas must be used respectfully.
Intimate acts or explicit sexual conduct are not permitted in common areas. Any behavior affecting coexistence may result in immediate removal without refund.
SERVICES, UTILITIES, AND INTERRUPTIONS
Due to the rural location, services may be limited or intermittent, including electricity, water, internet, and cellular signal.
Planta does not guarantee continuous availability of services. Interruptions caused by factors beyond its control do not constitute breach of agreement nor automatically generate a right to refund.
In case of emergency, communication may be limited due to lack of signal or electricity.
TRANSPORTATION AND PRESENCE ON PROPERTY
Planta does not offer nor guarantee transportation services under any circumstances, including emergencies.
There is no obligation to maintain permanent staff presence on the property.
The Guest is responsible for arranging their own transportation and contacting public or private emergency services if needed.
HEALTH AND MEDICAL EMERGENCIES
The property is located in a remote area. Medical services may take time to arrive. The Guest is responsible for having medical insurance and coordinating their own medical care.
CONDUCT AND SUBSTANCES
Illegal substances are prohibited. Disruptive behavior may result in immediate removal without refund.
CARE OF THE SPACE AND MATERIAL RESPONSIBILITY
The Guest accepts full responsibility for damages caused by action or omission, including furniture, structures, mosquito screens, installations, equipment, plants, or animals.
AUTHORIZATION OF CHARGES
I authorize Inmobiliaria A04, S.A. de C.V. to charge for damages or outstanding balances.
PERSONAL BELONGINGS
Planta is not responsible for loss, theft, or damage to personal belongings.
COMMERCIAL USE AND RECORDINGS
Any commercial use requires prior written authorization.
SECURITY CAMERAS
Security cameras exist in common areas only. No cameras are installed inside cabins or bathrooms.
CANCELLATION POLICY
All reservations are final and non-refundable.
FORCE MAJEURE
In events that objectively prevent operation, rescheduling may be offered subject to availability.
MANDATORY SIGNATURE
This agreement must be signed within 72 hours after reservation confirmation.
PRIVACY NOTICE
Personal data will be protected in accordance with applicable Mexican law.
TEMPORARY NATURE OF OCCUPANCY
The stay is temporary and does not generate tenancy or possessory rights.
RIGHT OF ADMISSION
Planta reserves the right of admission and continued stay.
ASSUMPTION OF RISK AND RELEASE
The Guest assumes all risks and releases Inmobiliaria A04, S.A. de C.V., except in cases of proven gross negligence or willful misconduct as provided by law.
JURISDICTION
This agreement shall be governed by the laws of the United Mexican States. The parties submit to the competent courts of the State of Oaxaca, Mexico.
By confirming the reservation or entering the property, the Guest fully accepts this agreement.
